Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Airix LLC ("Airix," "we," "us," or "our") governing your access to and use of the Push Up Arena mobile application (the "App") and any related services we provide (collectively, the "Services").

By downloading, installing, or using Push Up Arena, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Push Up Arena. By using the App, you represent that you are 13 or older and that you have the legal capacity to enter into this agreement. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

To use the App, you must sign in using Sign in with Apple or Sign in with Google. You are responsible for:

  • Maintaining the security of the account you use to sign in
  • All activity that occurs under your account
  • Providing accurate information when prompted
  • Notifying us promptly at support@pushuparena.app if you suspect unauthorized access

We may suspend or terminate accounts that violate these Terms, are inactive for extended periods, or that we reasonably believe pose a security or legal risk.

3. Subscriptions, Free Trials, and Billing

3.1 Subscription Service

Push Up Arena offers paid subscriptions that unlock additional features. Subscription pricing, billing intervals, and feature details are displayed in the App at the point of purchase.

3.2 Free Trials

We may offer a free trial period for certain subscriptions. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged at the then-current price. Free trials may be limited to one per user, and we reserve the right to modify or end free trial offers at any time.

3.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your payment method will be charged automatically by Apple or Google.

3.4 Managing and Canceling Your Subscription

All subscriptions are processed by Apple (App Store) or Google (Play Store), depending on where you downloaded the App. To manage, change, or cancel your subscription:

  • iOS: Settings → [your name] → Subscriptions
  • Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions

We do not control the billing process and cannot issue refunds directly. Refund requests must be submitted to Apple or Google according to their respective policies.

3.5 Price Changes

We may change subscription prices from time to time. Price changes will not affect your current billing cycle. We will provide notice through the App or via the App Store / Play Store before any price increase takes effect, and your continued subscription after the change constitutes acceptance.

4. License to Use the App

Subject to your compliance with these Terms, Airix grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App for your own personal, non-commercial use on devices you own or control.

This license does not grant you the right to:

  • Copy, modify, distribute, sell, lease, or sublicense any part of the App
  • Reverse engineer, decompile, or attempt to extract the App's source code
  • Use the App to build a competing product or service
  • Remove or alter any proprietary notices in the App
  • Use the App in violation of any applicable law or regulation

5. Acceptable Use

When using Push Up Arena, you agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to our systems, other users' accounts, or any data not belonging to you
  • Interfere with, disrupt, or overload the App or its underlying infrastructure
  • Use automated tools, bots, or scripts to interact with the App in ways not intended
  • Submit false, misleading, or fraudulent information
  • Harass, abuse, or harm other users (this becomes especially relevant if and when social features are added)
  • Circumvent subscription, trial, or access restrictions

6. Health and Fitness Disclaimer

Push Up Arena is a fitness tracking and motivation app, not a medical service. The App, its content, and any information it provides:

  • Are for general informational and motivational purposes only
  • Do not constitute medical, health, or fitness advice
  • Are not a substitute for professional medical advice, diagnosis, or treatment

You should consult a qualified healthcare provider before beginning any new exercise program. Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptoms. You assume all risks associated with using the App and engaging in physical activity. Airix is not responsible for any injuries, health issues, or other harms resulting from your use of the App.

7. Intellectual Property

The App, including all software, design, text, graphics, logos, and other content (excluding any content you submit), is owned by Airix LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

"Push Up Arena" and the Push Up Arena logo are trademarks of Airix LLC. You may not use these marks without our prior written permission.

8. User Data

Your use of the App is also governed by our Privacy Policy. The Privacy Policy describes how we collect, use, and protect your information.

You retain ownership of any workout data you generate through the App. By using the App, you grant Airix a limited license to store, process, and use that data as needed to provide the Services to you.

9. Third-Party Services

The App relies on third-party services, including authentication providers (Apple, Google), backend infrastructure (Supabase), and subscription management (Superwall). Your use of these services is also subject to their respective terms and privacy policies. We are not responsible for the actions, omissions, or content of third parties.

10. App Store Terms

You acknowledge that these Terms are between you and Airix LLC, not with Apple or Google. The App Store and Play Store are not responsible for the App or its content. To the extent these Terms conflict with the applicable App Store or Play Store terms, the App Store / Play Store terms govern but only to the extent of the conflict.

If you downloaded the App from the Apple App Store, you acknowledge that Apple is a third-party beneficiary of these Terms and may enforce them against you.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, Airix disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any data you store in the App will be retained or backed up indefinitely.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Airix LLC and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the App.

Our total cumulative liability for any claims arising out of or related to these Terms or the App will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Airix LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit through the App.

14. Termination

You may stop using the App at any time and delete your account through the App or by emailing support@pushuparena.app.

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Services. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including Sections 7, 11, 12, 13, 15, and 16) will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the App will be resolved in the state or federal courts located in Wisconsin, and you consent to the exclusive jurisdiction of those courts. Where applicable consumer protection law gives you rights to bring proceedings in your country of residence, this clause does not affect those rights.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, for material changes, provide additional notice through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

17. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Airix regarding the App.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
  • No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: You may not assign these Terms without our written consent. We may assign these Terms freely.
